Iron bracket (the “Service”) is operated by Ironbracket Inc.(“we”, “us”, or the “Seller”), trading as “Iron bracket”. By creating an account or using the Service you agree to these Terms & Conditions. If you do not agree, do not use the Service.
1. Acceptance and Authority
By using the Service you confirm that you are of legal age in your jurisdiction (or have the consent of a parent or legal guardian) and, if using the Service on behalf of an organization, that you have authority to bind that organization to these Terms.
2. The Service
Iron bracket is an online platform that helps organizers run single- and double-elimination arm wrestling tournaments, publish events, manage participants and match calls, and helps athletes discover events, register, and track rankings. Equipment vendors may pay for a monthly listing in the equipment marketplace.
3. Accounts
You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4. Acceptable Use
You must not misuse the Service. In particular, you must not:
- use the Service in violation of any law or third-party right;
- use the Service to commit fraud, spam, harassment, or impersonation;
- infringe intellectual property or publicity rights of others;
- attempt to gain unauthorized access, probe, scan, or interfere with the security of the Service or any related infrastructure;
- upload malware, or scrape or bulk-extract data from the Service.
5. Assumption of Risk
Arm wrestling is a contact strength sport that carries an inherent risk of injury, including serious injury. By registering for events through the Service, you acknowledge and voluntarily assume all risks associated with participation, training, travel, and any related activities.
6. Payments, Subscriptions and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payments, billing, taxes, invoicing, subscription renewals, cancellations, and refunds are governed by Paddle's Checkout / Buyer Terms and Refund Policy, in addition to our Refund Policy.
Paid subscriptions renew automatically at the interval you selected (monthly or annual) at the then-current price until cancelled. You may cancel at any time from your account or by contacting Paddle; cancellation takes effect at the end of the current billing period and no partial-period refunds are given except as required by law or by our Refund Policy. Applicable taxes are collected by Paddle where required.
7. Intellectual Property
The Service, including its software, design, logos, text, graphics, and other content that we create, is owned by Ironbracket Inc. and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works of the Service except as expressly permitted.
You retain ownership of content you submit (event details, results, photos, videos, messages). By submitting content you grant us a worldwide, royalty-free licence to host, display, reproduce, and distribute that content solely to operate and promote the Service.
8. Privacy
Our collection and use of personal data is described in our Privacy Notice.
9. Refunds
Our refund terms are set out in our Refund Policy. Refund requests are handled by Paddle as our Merchant of Record.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components.
11. Limitation of Liability
To the fullest extent permitted by law, in no event will Ironbracket Inc. be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, bodily injury, or property damage, arising out of or relating to your use of (or inability to use) the Service, your participation in any event listed or registered through the Service, or interactions with other users or organizers. Our aggregate liability for any claim relating to the Service is limited to the greater of (a) the fees you paid us in the twelve (12) months preceding the claim, or (b) CAD $50. Nothing in these Terms limits liability that cannot be limited by law (such as fraud, death or personal injury caused by negligence).
12. Indemnification
You agree to indemnify and hold harmless Ironbracket Inc. from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from your use of the Service, content you submit, your violation of these Terms, or your violation of any third-party right.
13. Suspension and Termination
We may suspend or terminate your access to the Service, in whole or in part, for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, licences granted to you cease; sections that by their nature should survive (IP, disclaimers, liability, indemnity) will survive.
14. No Endorsement
Events, organizers, athletes, clubs, and equipment listings on the Service are not endorsed by Ironbracket Inc. The Service merely facilitates discovery, registration, and payment processing.
15. Governing Law
These Terms are governed by the laws of the Province of Quebec, Canada, and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Disputes will be submitted to the exclusive jurisdiction of the courts of Quebec, except where mandatory consumer-protection law provides otherwise.
16. Changes
We may update these Terms from time to time. We will post the updated version here and update the “Last updated” date. Continued use of the Service after changes constitutes acceptance.
